Benjamin's Concrete and Landscaping

1. General Terms By engaging with Benjamin's Concrete and Landscaping, its advertisements, or its services, customers acknowledge and agree to these Terms & Conditions. The business reserves the right to change, withdraw, or modify any promotional offers or pricing without prior notice. Promotional engagement does not establish a binding agreement until an inspection or

consultation has been completed and a formal quote provided.

2. Offers & Promotions

  • All offers advertised via Meta (Facebook & Instagram) or other platforms are time-limited, subject to availability, and may be withdrawn or changed at any time.

  • Promotional messages such as:

    ○ “DOUBLE DRIVEWAY FROM JUST $5,500 – EXCAVATION INCLUDED!”

    ○ “MASSIVE WINTER SPECIAL – 30% OFF + DONE IN 3 DAYS!”

    ○ “FREE UPGRADE to EXPOSED AGGREGATE – Next 5 Customers Only!”

    ○ “Driveway in 7 Days or Get $1,000 Back!” are estimates only and dependent on various job-specific factors.

  • Promotions are valid only when explicitly stated in a formal quote following inspection.

  • The business is not responsible for assumptions made based on marketing materials.

3. Site Inspection & Pricing

  • Final pricing is confirmed only after an on-site inspection or consultation.

  • Factors influencing pricing include, but are not limited to: size of area, site conditions, access, drainage, type of finish (e.g., plain, coloured, exposed aggregate), excavation requirements, and any additional or optional services.

  • Customers agree that all promotional prices are indicative and subject to change after assessment.

4. Booking, Deposits & Payment

  • A deposit may be required to secure a booking. The deposit amount and balance payment terms will be outlined in the final quote.

  • Final payment is due upon completion of the work, unless otherwise agreed in writing.

  • Late payments may attract penalties or interest charges.

  • Deposits are non-refundable unless Benjamin's Concrete and Landscaping is unable to deliver the agreed service.

5. Service Limitations

  • Services offered are limited to concreting and landscaping as quoted. This includes but is not limited to residential and commercial concreting, landscaping, and driveway installations.

  • The business does NOT provide structural engineering, underground utility works, or modifications outside the agreed scope.

  • Any additional work identified or requested must be quoted and approved separately in writing.

6. Liability & Warranty

  • Benjamin's Concrete and Landscaping is not responsible for pre-existing issues or damage not caused by its workmanship.

  • The business is not liable for indirect, incidental, or consequential damages including subsidence, cracking due to shifting soil, or customer dissatisfaction from unrealistic expectations.

  • All services are delivered 'as is' with workmanship warranties specified in writing where applicable. No additional guarantees are provided unless clearly stated.

7. Consumer Rights & Dispute Resolution

  • These Terms & Conditions do not override customer rights under Australian Consumer Law.

  • In the event of a dispute, the business and customer agree to pursue amicable resolution through open communication before initiating legal proceedings.

  • Legal matters shall be governed under the relevant Australian jurisdiction.

By proceeding with any quote, booking, or engagement, customers confirm they have read, understood, and agreed to these Terms & Conditions.
